In this Terms and condition of sale , for the purpose , whenever the context so requires “You” or “User” shall mean any natural or legally bindingperson who is a guest user or a registered user of the Website(.citizenalley.com) or the mobile app as a buyer, and the terms-“Seller” means the seller of the goods/product in the Website. The term “We”, “Us”, “Our”, or “citizenalley”, “www.citizenalley.com” shall mean Santhosh V.

The domain name citizenalley.com and it’s mobile application under the name and style “citizenalley” (hereinafter referred as “Website”) is owned by Santhosh V a Proprietary firm having its registered office at A-19, C/O Suma Divakar, TC-22/1039, CPGP Lane, Sasthamangalam, Thiruvanathapuram , Kerala, India (hereinafter referred to as “citizenalley.com or simply Citizenalley).

In these Terms and condition of sale “Goods” means goods, product and material manufactured, imported, supplied and/or delivered by Seller to Buyer, as such was approved by Seller in reply to the Buyer’s order and accordingly listed in the “Order approved”. “Order Approved” in respect to the Buyer’s order means the instrument issued by Seller, bearing the same order no of such order and specifying, among other items, the terms of Goods, including their respective price quantity, which shall be supplied to Buyer upon such order.

Citizenalley as a venue

Citizenalley acts as a venue to allow users who comply with Citizenalley's policies uy goods within a fixed-price format. The website or the mobile app is only a venue through which Users can reach a larger base to buy items.

Citizenalley is a service to facilitate the engagement of the user and the buyer . All the information and products listed on the Website/App are provided 'as is where is'.

1.Price, Duties & Tax

Prices projected in the order total are net. Prices are based , inter alia, on production cost, supplies, labor, duties, and services; current on the order date. In the event any changes in the material cost, or duties etc. the We reserve the right to either adjust the price for the Goods or cancel the sale relating to undelivered Goods, In such case the Buyer can demand for a Replacement or can except the new condition put forth by the Seller (please refer our Replacement/Exchange Policy for more information) . Government taxes, duties, levies or any other compulsory payment as directed by the government of India is applicable to the sale of Goods any time, as well as Delivery charges, insurance, and freight expense shall be borne by the Buyer and be paid in full, unless otherwise expressly stipulated.

2.Delivery Terms & Conditions

We have contracted 3rd party shipping company for all our delivery services, we expect a total participation from you, in order to make the delivery service successful

2.1 Serviceable Pin code

Due to the nature of the product/Good manufactured, the supply of the Goods to a particular area or pin code; will be the sole discretion of the Us.

This could also mean, some of the pin codes are not serviceable by the Delivery company contracted by us.

2.2 Estimated shipping date & Estimated Delivery Date

While booking your order you are expected to notice the Estimated shipping date & estimated delivery date on the product page as well as on the shopping cart; before placing the order. Please note that this is not a guaranteed delivery date for your order since some areas may take longer due to the frequency of deliveries to the pin code or may be due to the climatical and terrain condition of the serviceable pin code.

However, our system calculates this estimated date taking into account

When the delivery provider receives your order at the local distribution center, they will attempt to contact youto provide the approximate time window for your scheduled delivery; on the telephone provided at the time of booking the order. Delivery will be made between 9am to 6pm on the delivery day you select.

2.3 Delivery Acceptance

• Once the delivery day and the time windowhas been notified to you by the local delivery person, please ensure either you or your representative, who is 18 yrs or older to be present , to receive the order.
• In absence of the receiving person, the merchandise will be taken back to the delivery facility, and a re-delivery fee may be applied to your order.
• Neither Citizenalley nor the 3rd party delivery company contracted by Citizenalley will be held responsible if you choose to hire a 3rd party contractor to accept/receive and sign the order without notation of visible defects of packaging, damaged item or missing accessories/parts.

2.4 Delivery acceptance responsibility

You or your representative are requested to sign the delivery note in presence of the delivery company representative after your examination to ensure there is no visible damage to the package, missing or incorrect order no.In the event ofdamaged, missing or incorrect package , please retain the item(s), indicate the problem on the delivery note and contact us within 24 hrs of your delivery,

2.5 Additional Fee Acceptance.

There may be a circumstances where you might be charged for additional fees if the condition mentioned above is not met or you need a service outside our standard delivery policy like you might require a different time window, no one available to receive the order on the scheduled delivery time window or delivery can’t be made due to unsafe conditions etc.

2.6 Changing of delivery address after placing the order

Once an order has been placed indicating the shipping address, we cannot make any changes. The order gets processed within few minutes in our system once the order is placed online, to ensure a smooth order fulfillment and shipping time.

If for some reason shipping address has to be changed please cancel the existing order and place the order again; within the cancellation time window( for more information on cancellation policy please refer to our cancellation policy in our Citizenalley Replacement Policy )We apologize for the inconvenience.

3. Transfer of Title of the Goods

The title of the Goods shall be passed to the Buyer by Us upon the full payment or by the payment of any outstanding debt by the Buyer to Us.The Buyer acknowledges that as long as the title has not been transferred in the Goods( in case of COD outstanding or returnable Goods), it holds the Goods as bailee and fiduciary agent for the citizenalley and shall ensure safety and securely store and keep the Goods separate in good condition as received by the Buyer and shall record the citizenalley ownership of the Goods in its book.

5. Claims and liability

Unless the Buyer notifies Us within 24 hrs from the receipt of the Goods, for any matter or dispute by reason, whereof, it has alleged that the Goods is not in accordance with the contract, the Goods delivered shall be deemed to be delivered and accepted by the Buyer in all accordance with the contract, and the Buyer shall not reject or raise any claim for the damage or any other reason as a result of the alleged negligence/breach of warranty and/or any condition.

In case of any dispute brought in the notice to Us about the Goods delivered subject to the conditions above, the Buyer must provide valid proof to the satisfaction, that it followed all the instruction for the use, storage, maintenance and handling of the Goods.

6. Cancellation

Goods manufactured as part or, in whole, on a “made to order” basis cannot be canceled by the Buyer without written notification to the us, on terms, which will compensate the Manufacturer/wholesaler/retailer for any resulting losses both to the Seller and Us.
Products booked Can be cancelled with in 1 hr of Placing the order, this is to avoid unnecessary delay in processing the order, to ensure a smooth order fulfillment and shipping time.

7. No-Assignment

Buyer’s rights and obligation arising due to the contract will not be assigned, without the prior written consent of the Us.

9. Jurisdiction

It is agreed by Buyer , that these Terms and condition of sale shall be governed in accordance with the laws of India under all circumstances, without reference to conflict of laws principles.

It is agreed by You, that claims, differences and disputes arising under or in connection with or in relation hereto the Website, these General Terms of Use, the Agreement(s) (Terms & Conditions) or any transactions entered into on or through the Website or the relationship between Buyer and Citizenalley shall be subject to the exclusive jurisdiction of the courts at Thiruvanathapuram, India and You hereby accede to and accept the jurisdiction of such courts. Each party hereby irrevocably waives any objection which such party may now or hereafter have to the laying of improper venue or forum non-convenient. Each party agrees that a judgment in any such action or proceeding may be enforced in other jurisdictions by suit on the judgment or in any manner provided by law. Any and all service of process and any other notice in any such suit, action or proceeding with respect to this Agreement(s) (Terms & Conditions) shall be effective against a party if given as provided herein.
